Supreme Court Justice BV Nagarathna has made an important comment on the dispute between the governments and governors in many states. Addressing a conference, she said that in some states, governors do not do the work that they should do. But they are ahead in doing those things which they should not do. She said that governors should remain neutral. Referring to Durgabai Deshmukh, Justice Nagarathna said that she used to say that the role of governors should be to promote harmony and they should be beyond politics. Durgabai Deshmukh was a member of the Constituent Assembly and was the wife of Chintamanrao Deshmukh, who was the first Finance Minister of independent India.
The Supreme Court judge said that some duties can be expected from governors. We wanted to describe governors in the constitution so that their work promotes harmony. Their work should be such that some coordination can be made between two opposite poles. It is important that the governor can be kept above politics. He should stay away from political matters so that no kind of dispute can happen. But it is unfortunate that in today’s India, governors are doing those things which they should not do. But they seem to be inactive in those things which are expected of them.
Justice Nagarathna said that we should take care of the federal structure. Apart from this, there should also be a discussion on fundamental rights and principles. He said that the important thing is that both the state and the center should understand that they have a mandate to fulfill national and regional expectations. The judge emphasized that the states’ views should be given importance, their rights should not be weakened. He said that the most important thing among all things is the Constitution. It inspires us and presents a solution to every situation. It constantly reminds us of democratic values.
