Amendment to the Constitution of Pakistan; Henceforth, the parliament hires judges

The Parliament of Pakistan on Monday, October 21 (30 Mizan) approved the amendment to the Constitution, according to which the legislators will have more authority in the appointment of judges.

Meanwhile, a number of judges’ verdicts were issued in favor of Imran Khan, the former Prime Minister of Pakistan.

Since the elections were marred by allegations of fraud in February, relations between Islamabad and the Supreme Court have also been strained.

According to the judicial reforms approved by the Parliament of Pakistan, after this a parliamentary committee will select the judges and the term of office will be for three years.

Meanwhile, Faiz Isa, the judge of the Supreme Court of Pakistan, will soon retire.

According to the previous law of Pakistan, Isa’s position should have been taken by Mansoor Ali Shah, the acting judge Arshad.

Sardar Shahbaz Ali Khan Khosa, a senior member of the Supreme Court of Pakistan Lawyers Association, said that this is a deliberate attempt to undermine the independence of Pakistan’s judicial system.

He added: “They tried to destroy the basic principles of the constitution of Pakistan. We reject this and we will fight against it in every association of lawyers.”

Shahbaz Sharif, the Prime Minister of Pakistan, reacted by saying that this is a “historic day” if the Supreme Parliament approves the amendment.

Umar Ayub Khan, a member of the Pakistan Tehreek-e-Insaf and the leader of the opposition party in the parliament, told the lawmakers that this amendment is like weakening the independence of the judicial system.

And he added: “If a government is formed on the basis of taqbal votes, it cannot amend the constitution.”

Meanwhile, a number of Pakistani media have reported that this amendment will increase competition between government agencies.
